what do you do about stealing work and selling it by VCR-WOLFE

i got a tip from someone about a person tracing(perhapppss??) my work and making a profit off of it on t-shirts

ill just copy-paste the note they sent me since the information works well enough:

Hi, i found a person who re-drawed your work ( http://r-wolfe.deviantart.com/art/Pastel-Baphomet-10-CLOSED-354136639 ) and now is selling t-shirts with this image. ( http://imageshack.com/a/img849/827/k7zq.jpg#_=_ )

She is a little famous and she make like 1000$ on shirts (not only with your art)

pthhhh issue is i guess bc the site being used for the sale is in polish and im,,,, i dont know any polish

whoops what shall i do, any advice ya guys?

    I would contact the owners of the site with your complaints. They should be able to read english, I hope. :P

    A short and sweet letter to the owner.

    "Here is my picture. Here is the stolen picture. I hold a copyright that you are infringing upon. Take down this product, or I find a good lawyer to make your company mine. Good day."

    First, it is on YOU to Prove your art has been stolen.

    The pose itself... can't be copyrighted...? However if it is a direct trace, you can make an overlay and animate the cross fade to show that the artist traced your work. This will also show you if it's a trace or if the pose was just used.

    Once you have the evidence, contact the artist with a cease and desist order. If they ignore it, send one to the company with the proof.

        An overlay cross fade can determine that real quick.

    If you can prove it's a trace over, try to find some dates to cross reference when you uploaded vs. them. Just helps in your argument, I guess the best thing to do is contact the user directly with your proof, then if they don't do anything then contact the site (even if it's polish D: )

    sadly, at a glance to me it looks more like "heavily eyeballed" than "directly traced".
    or they traced but purposefully deviated from the lines a bit so they don't overlay perfectly. which is just as much theft but makes it harder to prove....

    yeah i think that's exactly what they did....

    which to me says this is a career thief who thinks they're clever and tricky.

    i hope an overlay or just the comparison is proof enough and they respond to you and handle it because this is some shitty poop right here.

      yeah no from the overlay they changed some stuff but there is a lot of direct tracing which is makin me go HMMMMM

        good! i'm glad the overlay works so you'll have the best kind of proof!

        i took a look at their inventory and, yeah this person needs to be stopped. i don't know exactly where they stole the other designs from but theft is obviously what they do best.

    Honestly you'd likely be surprised at how much English is used as a business language in Europe and Asia. Even if they don't speak or write English well, they can most likely understand it.

    I'm willing to help out however I can - I have a friend who speaks Polish and could have a look at a message for you if you need it still.

    that looks like its gonna be really hard to call out... it looks obviously traced but in the interest of legal concerns they probably have a case in saying "you don't have copyright on the pose!"

    shitty situation and it's even worse when they can worm their way out of it u_u

    I hate to say it, but I doubt much would be done. The trace looks too different from the original, so it could easily be dismissed.

    I gave you a small signal boost on Twitter but from what I read I think you already got some help. Awesome! Hope this gets sorted out. Tracing is hella wrong, especially making profit off of it. :/

    This has happened to me[and the thieves mass produced them and sold them at CONS, a store in california, and on AMAZON.]
    Best is to email with a cease and desist, then open up a case with http://www.dmca.com/takedowns.aspx

    I've heard this happens on a lot of Polish site, and apparently in Poland they just don't give a fuck. I hope you can at least get them to remove it.

    I think... if you wanted to contact the website owners, I would first write up what I had to say in english, and then below it, use a google translate and repost. Chances are, they'll have somebody who can at least read a little english. From there they could probably piece together with the translation what you are trying to say.

    Hopefully that makes sense. :x
