Please read through them thoroughly.

These terms are subject to change without prior notice.
If you sign the agreement without reading the TOS, thats on you not us.

Ordering Process:

Any inquiries for project quotes should be sent through this form. The response will include the price for the described project and the 30% non-refundable deposit. MelonBerry Creations will then send an invoice for the deposit once the full project cost is accepted. Paying the 30% deposit places the project on the queue. If the project is a rush order, the rush fee must be paid with the 30% deposit.

The places in queue are determined first by deadlines and second by orders, with the earlier requested projects before newer projects. Items necessary for sizing - shoes, Duct Tape Dummy, hand tracing, and measurements - will be requested and required before the client's turn in queue. At that point, the client will have the artist's attention with questions to detail and numerous work-in-progress (WIP) photos.

These photos are provided at various steps in construction, including but not limited to, foam work of head or feet, partially sewn items, and completed parts of a set. Any angles or other photos can be provided upon request. A set of photos will be provided for the completed piece and MelonBerry Creations will provide a shipping quote. When final photos are approved, the original cost paid plus shipping paid in full, the costume is sent home!

Please keep in mind that your suit commission may and can take a couple of months to complete. If you dont like the fact that it may and can take that long then we will give you your money back.

Quotes:

Quotes are fully discussed and agreed upon between the company and the customer. They are only good at the time they are originally quoted and will expire after a month's time due to possible price-changes.

Reference Guidelines:

Project references are to have three angles, and list any pertinent information on the image. No regular illustrations, sketches, or links are accepted.

Terms Of Service:
Rights and Responsibilities:

• MelonBerry Creations is a privately owned and operated business and has the right to refuse service to any individual.
• MelonBerry Creations retains the right to terminate services to any customer found in contempt of the Terms of Service, all customers of MelonBerry Creations must read and agree to the Terms of Service.
• MelonBerry Creations retains ownership of all items until final payment has been confirmed, as such this studio may modify, resell, or re-purpose any project which has been abandoned by the customer, or in which the customer is found to be delinquent in payment.
• MelonBerry Creations retains copyright of all studio photographs. Permission must be attained to modify or redistribute studio photos. If you wish to purchase the copyright you are more then welcome too.
• MelonBerry Creations will enter into record and hold all transactions and information provided by the customer.
• Creations by MelonBerry Creations are works of art first and wearable articles second. MelonBerry Creations is not responsible for any damages to person(s) or creations through miswear and misuse, respectively. Damages can include exhaustion, heat stroke, or other injury due to the wear of these creations. It is up to the wearer to be safe, hydrated, and careful.
• All customer information will remain anonymous to MelonBerry Creations employees, unless a legal request is made by a legal authority of the United States of America.
• Commissioners have the right to cancel the commission at any time, however once the initial deposit has been paid it is non-refundable.
• This TOS protects only MelonBerry Creations customers. Customers which cancel the commission voluntarily, or are found in contempt of the terms of service may have their information used in relevant venues to inform other professionals in the field.

Deadlines:

We do not accept firm deadlines. Please understand that the creation and building of fursuits and fursuit parts takes time, as does ordering fur and other materials that are needed. Also remember that there may be other commissions ahead of yours, and that progress does not happen overnight. If you have a convention you would like to debut the suit at please do let us know and we will do our best to get it to you by then.

Deposits:

• Deposits are non-refundable at any time.
• A 30% deposit is required on all standard fursuit commissions in order for the customer to be placed into the project queue and for work to be started on the commission. You have to pay the 30% to be added to the Queue.
• Small commissions and parts may require a 50% deposit.

Required Information and Material:

• All deposits are final and will not be subject to any refund in part or in whole.
• All required information will be requested by Melonberry Creations to complete the commission and must be provided by the customer.
• Once the deposit has been paid by the customer all requested information and materials must be provided within three (3) months. Failure to comply will result in termination of the commission.
• Any items which are for children MUST be ordered by parents and MUST provide proof of age, in the form of a current and valid photo ID. (Scans of Photo ID or Photo Copy mailed to us is fine.)
• Due to the COPPA law, NOTHING will be shipped to ANYONE that is under the age of 18 WITHOUT your parents prior consent. You HAVE TO HAVE your parents call us at our listed number BEFORE we will ship you ANYTHING.

Payment:

PayPal: (Verified)
Payments take 3-5 days to clear, there will be a waiting period to allow payments to clear. If your PayPal name or address does not match your shipping address we will have to request you change it or use another method to avoid fraud. If you are using a friend or loved one's account we need verification by them that you are allowed to use it.

When paying with PayPal, do not, under any circumstances, send the payment as a "Gift." Please mark it as "Goods."

Money Order: (USPS only)
United States Postal Service money orders are preferred, but other money orders are acceptable. 1 day wait period for payment to clear.

Personal Check:
Please be sure that you contact us for the name the check is being paid to. There will be a waiting period to be sure that the check is indeed valid and will not bounce. This waiting period can be up to a week. If your check bounces you are liable for ALL fees, including paying back us and our bank.

Cash (AT CONS ONLY!)
We do not allow you to send cash through the mail. You are only allowed to pay Cash to us at a con.

Debit/Credit Cards:
We can take them either through our website or at a con. Just make sure you have a Photo ID with you so we can check the name and make sure you are using your OWN card.

Payment Plans:

• All payment plans must be agreed upon by MelonBerry Creations and the customer before commission work begins.
• Initial deposit is still required before the project will begin or the customer placed into the queue.
• No payment plan will last more than five (6) months to fully pay off, unless talked about prior.
• Final payment must be made before the suit is delivered.
• Failure to meet payment deadlines will result in the commission being terminated.

Due Dates and Queue:

• Customers are placed on the queue only after the initial deposit is paid.
• The Deposit is Non-Refundable at any time.
• The due date of a suit will be set only after all necessary information has been provided by the customer.
• Customers seeking a particular completion date must discuss this date beforehand and must have this date approved by MelonBerry Creations. If confirmation has not been given the completion date has not been set.
• If you want it rushed there WILL be a fee.

Terminated or Abandoned commissions:

Terminated or Abandoned commissions

• A commission will be considered abandoned if required information or materials are not provided within three (3) months after the deposit has been paid.
• A commission will be considered abandoned if no payment or contact is made two (2) months after required information or materials are provided.
• A commission will be considered abandoned if final payment is delinquent for one (1) month after the previously agreed upon date.

Reasons for commission termination may include, but are not limited to: Threats to MelonBerry Creations employees or studio, harassment of any MelonBerry Creations employees, failure to provide required information, failure to provide payment, violation of the TOS, and any behavior which will ultimately reflect negatively on the MelonBerry Creations brand.

• If a commission has been abandoned or terminated all project materials will be retained by MelonBerry Creations. Physical materials such as Duct Tape Dummies may be returned at the expense of the individual upon request.
• Refund options may be available for cancellations made by the customer; the initial deposit is non-refundable.

Domestic and International Shipping:

Shipping

• All items will be shipped via UPS/FedEx.-Shipping is not included with quotes.
• No shipping information will be falsified by MelonBerry Creations for shipping purposes.
• All items will be shipped with insurance (if items are over $100), tracking information, and will require signature upon delivery.
• The buyer is responsible for all shipping costs. Also, We are not responsible for any extra charges that are added once delivered. Keep in mind we will be sending from the US, posting overseas costs a fair bit!
• All items will be shipped to the address provided by PayPal; shipping address may only be changed with proof of ID or residency. Items purchased through money order or check must verify shipping address.
• MelonBerry Creations is not liable for any items lost or damaged during shipping. All shipped items are insured (if item is over $100), include tracking, and require signature upon delivery allowing customers to open disputes with the UPS/FedEx.

International Shipping

Items requiring international shipping are subject to these additional requirements:

• The customer is responsible for all import fees or tariffs.
• Shipping may take additional time depending on the customer location.
• Standard tracking is unavailable and may only be attained through the customs form number.
• Insurance is unavailable on international items. MelonBerry Creations is not liable for item damage or loss.
• Any claim of loss or damage please contact us and we will contact UPS/FedEx to see what happened to your package.

Warranties and Repairs:

All warranties from MelonBerry Creations are non-transferable. Photographic evidence is required to document any damage or mistakes, for any repair claim. Repairs under warranty are free to the customer with a small fee covering shipping of the items in need of repair.

The following issues are covered under standard warranty for all MelonBerry fursuits: Repairs to seams, stitching, missing claws or teeth, split zippers, or other items which do not require additional materials.

The following items are not covered by the standard MelonBerry Creations warranty: Torn fabric, eyes or ears removed from the head, food stains, burn marks, human or animal waste, extensive damage requiring the use of new materials, any damage caused by negligence of the wearer or those around them.
Fursuits are consumable items, wear and tear due to age and use are not covered under standard warranty.

Construction flaws and builder mistakes are covered under warranty provided the claim and suit or parts returned for repair within 30 days from receiving the items, and the fursuit or parts have not been worn extensively or in public settings, such as meets or conventions.

Once a claim has been made the suit must be sent back for repairs within a week and may not be worn further due to risk of further damage.

Items which will result in the voiding of the warranty include but are not limited to:

• Use of any item for sexual purposes.
• Large scale fursuit modifications.
• Altering the suit so that it no longer reflects the MelonBerry Creations style and brand.
• Large scale repairs or alterations made to the suit by anyone except MelonBerry Creations employees.
• Intentional application of human or animal waste. -Intentional damage or destruction of the suit. -Intentional use in a pool, mud, paints, or other potentially damaging substances. -Contact or application of latex products with the fursuit or parts.

Repairs not under warranty or modifications may be made with a fee to the customer in addition to shipping.

Repairs are available on items created by other individuals or studios. MelonBerry Creations is not responsible for these repairs voiding any current warranty on the item.
