The first recorded use of the term "twelfth man" was in the November 1912 edition of The Iowa Alumnus.

In Jan of 2006, Texas A&M and the Seattle Seahawks entered into a lawsuit over who had claim to the "12th Man" banner. In May of 2006, it was decided that both teams could use the phrase. - "'12th Man' for everyone: Seattle, A&M resolve dispute". ESPN. 8 May 2006. Retrieved 26 July 2007.

Sometime between now and then, it seems it's become okay for any football team to use it because I see 12 jerseys in all kinds of colors, (including the US Navy); I just happen to live in WA.
