TERMS OF SERVICE
Aalst Aalsterman Enterprises

"Commission order form" may include informal agreements via IM or email. Correspondance is then done via email.

In providing the information listed in the order form via email or text, you, the Client, agree to these Terms of Service, which will not be superseded by any other terms unless agreed upon in writing. It is the responsibility of the Client to ensure they have read and understood the Terms of Service.

These terms of service are relevant to non-commercial projects only, and are subject to revisions and additions without notice. Proposals towards commercial projects and general questions can be emailed to the Artist himself at: arthurpearson@gmail.com.

Quotes, Payment, and Refunds:
1) The Artist charges a base rate of $30 an hour. All commission prices for pencils ($25), inks($25), flat color($35), and cel shading($45) are based off this standard. Rates are subject to change; however, commissions placed in-queue before any price updates will not be affected.

2) A preliminary quote will be given when a commission email is submitted. Upon the Client’s approval of the quote amount, and once the Artist is ready to start the commission, the Client will be sent an invoice to provide pre-payment for the commission if necessary.

The ONLY exception where prepayment is not necessary is for returning customers.

3) Livestream commissions, full payment is required up front. For "standard" commissions, the Client will provide 1/2 of the base price up front, with the remainder to be paid after completion.

4) Payment for commissions must be made via PayPal, check, bitcoin, or cash. Contact the Artist for details.

5) The Client has the right to cancel a commission at any time, but will not be refunded for hours of work already completed and approved up to the time of cancellation.

6) The Artist reserves the right to refund any Client in full and cancel a commission at any time, for any reason. The Artist may also cancel a commission due to personal emergencies that render the Artist unable to complete the commission in a timely, efficient manner.

7) The Artist will refuse to work with any Client under 18 years of age that wishes to commission mature material. If the Artist accepts a commission from a Client, and later discovers the Client is underage, the Client will be refunded immediately and the commission will be considered cancelled.

8) If the artwork is finished before final payments are made, the Client will not receive the original artwork or full size digital image of the commission until final payments are made.

9) If the Artist creates more artwork than what was initially asked for, the Client will not be charged for the extra work done.

Communication, Progress, and Cancellation:

10) Communication is like, you know, whatever your trip. Skype, ICQ, YIM, email... it's all good. You know where to get the info. If not, try arthurpearson@gmail.com.

11) If the Client is unresponsive to any attempted contact from the Artist for two months, starting from the first attempted contact, without warning the Artist of extended absences, the commission will be considered cancelled, the Client will be refunded, minus fees for work completed up to that point, and the Client’s slot will be given to another customer.

12) The Artist may take up to one year to fully complete a commission due to life obligations such as school and work. Any deadlines must be discussed in the initial commission proposal to be considered, before the preliminary sketch is started.

Notification will be given to the Client for major, unavoidable delays, such as extended vacations or school examinations.

13) The Artist will provide a rough preliminary sketch of the commission to show poses and content. One free major revision or redraw will be allowed at the sketch stage, one minor revision will be allowed at the color stage, and one minor revision will be allowed at the cel shading stage. Further changes than these may incur additional charges, depending on the extra time these revisions take. Preliminary sketches and works-in-progress will be low-resolution and watermarked. Revisions due to an oversight on the part of the Artist (such as missing key markings clearly marked on a reference sheet) will not be charged for, but it is the responsibility of the Client to be clear in their initial proposal.

14) Major revisions are defined as complete or near-complete redraws, such as repositioning limbs, changing an outfit, or completely editing the character’s pose. Minor revisions only involve changing small, individual details like adding jewellery or adjusting minor details in markings or small shifts in colour hues.

Content and Subject Matter:

15) The Artist retains the right to refuse any commission for any reason, even if the contents of the proposed commission are within the Artist’s acceptable guidelines. But it never hurts to ask. The extremes are what the Artist looks for.

16) The Artist will refuse to draw:
underage human characters in questionable situations

17) Questionable art will be considered on a case-by-case basis, so long as the commission does not include any of the elements mentioned above.

18) The Artist is willing to draw trademarked and “fan” characters, but the Client retains liability.

Display and Usage Rights:

19) The Artist retains the right to display all artwork in their personal website/galleries (e.g. DeviantART, Weasyl), and also claims the image rights to the artwork itself, which means that commissioned artwork may be sold as prints or other merchandise. Image rights can be negotiated by the Client for an additional fee. Credit to creating the artwork belongs to the Artist.

That said, I will honor commissions that are requested to be "private" kept so. Or at the very least change the names to protect the innocent.

20) The Client retains all rights to their depicted characters. The Artist does not take any claim to any characters they are asked to depict by a Client, unless a character depicted belongs to the Artist. The Client has limited rights for the personal use of completed commissions, which includes resizing, cropping, and limited printing for the purpose of personal display.

21) The Client may also re-post completed commissions on their personal website/galleries, and only if full credit and a link is given to the Artist. Reproduction of the commissioned image for sale is prohibited. If the Client wishes to edit the artwork they have purchased, they must send the Artist a copy, and clearly indicate what they edited in the image.

Shipping and Real Media:

22) If the Client wishes to receive the real media copy of their finished commission (or a high-quality photo paper print of a digital commission), they must mention so in their original commission proposal.

23) If a shipped print arrives damaged (excessively torn, crumpled, smeared), and if the Client provides photographic evidence of such damage (to both envelope/packaging and artwork), then the Artist will resend a new print at no additional cost. Traditional media pictures will not be redrawn if they arrive damaged, but the Artist can provide a replacement print created from a high-resolution scan of the picture as compensation.
