Commission Terms of Service 2015 by ChaosCanine

TERMS OF SERVICE

1) Displayed base prices are subject to change according to the complexity, difficulty, and size of each individual commissioned piece.

2) Clear and concise visual references and/or description of the commission idea must be provided by the Client, as well as an indication of the type of commission they would like (detailed illustration, character study, and etcetera). Supplementary references may be requested by the Artist if the Artist finds certain details unclear. After the project specifications and references are provided, the Artist will offer a price quote.

3) Payments of $100 and under must be made up front in full before preliminary work begins. Payments of more than $100 may be made on a payment plan in which one third (1/3) of the total cost must be paid before preliminary work begins. Payment plans must be explicitly stated and agreed upon up front before any initial work is done.

4) The Artist will provide an estimated turnaround period at the time of the first payment, unless a deadline has already been discussed. If unexpected issues arise, the Artist will contact the Client as soon as possible to provide a new estimated completion date. If this becomes excessive, the Client may request a partial refund (50% of what they paid) and the commission will be cancelled.

5) The Artist will only work to meet a deadline if the Client has started the commission process at least 2 months in advance of the desired deadline date. This time period is subject to change according to the complexity and amount of work required to be completed by the deadline.

6) If the artwork is finished before final payments are made, the Client will not receive the full resolution or un-watermarked digital image of the commission until all payment is completed. If the Client is unable to pay within 30 days of being notified of the completed commission, the Artist retains full and exclusive ownership of the work. The work may then be auctioned, resold, modified, destroyed, or otherwise disposed of at the Artist’s discretion.

7) The Client will have the opportunity to direct alterations of their commission in the ideation and sketch stage. The Artist will provide three to five loose thumbnail sketches from which the Client may choose before more work is done to refine and finish the drawing. No more than five sketch revisions (or equal in terms of small alterations) can be made unless the Client wishes to pay an additional charge for new sketches. The Client is expected to reply within 2-3 days to approve work, revisions, and changes. Communication and collaboration throughout the commission process is highly encouraged!

8) Final digital work will not be started by the Artist until the Client approves the preliminary sketch. Major revisions and alterations cannot be completed during the digital work phase of the commissioned artwork.

9) The Artist reserves the right to reject critique pertaining to artistic skill or style preference (i.e. anatomy, coloring style, and etcetera) if said critique reduces the artistic quality of the piece.

10) The Artist will not make an exact duplicate of a previous work or of the work of another artist, nor will the Artist work in a style clearly recognizable as that of another artist. Suggested inspirations may be accepted, but direct imitation will be avoided.

11) If the Client wishes to cancel their commission during the sketch stage, they will be refunded 50% of what they paid.

12) If the Client wishes to cancel their commission during or after the digital coloring stage, they will not be issued a refund. If the Artist completes the commissioned work agreed upon, but for some reason the Client does not accept it, no refund will be issued.

13) The Artist will not discuss a commission with the Client via public forum or instant messenger. Communications about commissions between the Client and the Artist will only be made through chaoscanine@gmail.com.

14) The Artist reserves the right to issue a refund and cancel a commission due to poor communication, rude or inappropriate behavior, or inability to communicate effectively in English.

15) The Artist reserves the right to interpret non-payment and lack of communication for 30 days following completion or approval of work (whichever is later) as the Client’s resignation of any and all claims, rights, and/or interest in the work. The work may then be auctioned, resold, modified, destroyed, or otherwise disposed of at the Artist’s discretion.

16) The Artist ensures that the Client will receive email updates on the commission when necessary. Clients are encouraged to check in when they feel it’s needed for updates, assurance, or reminders. Public updates may also be made via Twitter and Facebook.

17) The Artist will not handle depiction of illegal activities, extreme violence and gore, sexually explicit (x-rated) material, body horror, copyrighted characters, and hateful or offensive images. The Artist reserves the right to reject any commission for any reason.

18) The Artist retains the right to display all commissioned work on any personal website, online gallery, and social media channel. If the commissioned work is a time-sensitive gift, the Artist may delay public showcase at the request of the Client.

19) The Artist retains all rights to the commissioned artwork, including the right to make prints and merchandise. The Artist will not make prints and merchandise out of company-specific logos and other branding materials unless requested or granted permission by the Client.

20) The Client retains all rights to their respective characters and ideas. This does not allow them rights to the commissioned work.

21) The Client may not profit from the commissioned artwork. This includes the sale of the digital files, redistributions and reproductions, or rights to the image.

22) The Client cannot alter the artwork itself; however, the Client may resize/crop the commissioned artwork to create icons, wallpapers, or other graphics to be used in non-commercial digital format. The Client may also upload the artwork to their personal website or gallery, but credit is required; the Client may not claim the artwork as their own work. The Client must not upload the high resolution or un-watermarked version of the artwork.

23) The Artist is not responsible for printing. High-resolution files of the commissioned work will be emailed to the Client to use for printing at their own personal cost.

24) The Artist may recycle sketches and preparatory works that were rejected by the Client for other commissions or personal works.

25) If the Client is under 18, they must supply contact information for their parent or guardian. The Artist has the right to contact the parent/guardian of an under-aged Client to ensure that there is no conflict of interest and that the minor is able to pay for the commission.

26) The Client must read, understand, and agree to all the above terms before entering into an agreement with the Artist. By sending payment, the Client agrees to the above terms. Payment must be sent before work begins to chaoscanine@gmail.com via PayPal in American U.S. Dollars. The Client must not send payment until the Artist agrees to take the commission.
