Terms of Service for Fursuit Purchases

Everywhere I say "you", I refer to any person who makes a purchase from me.
Let it be noted that my house has cats in it.
Due to questions of legality and other technical mumbo-jumbo, I will not do business with minors.
The following terms are subject to change with or without notification (likely with, if you're commission is in progress).

Design:

  • It is recommended that you provide me with a duct tape dummy, so that I have what is essentially a body-double of you. This way I can test the way your fursuit will fit you before sending it to you.
  • In the case of foot paws, you must supply me with a pair of canvas shoes that fit you, so that I have a base to work off of.
  • Visual references of the character must be supplied. Simply describing what the character should look like won't work, because you and I could have different interpretations of those words.

Payment:

  • Payment will be made through PayPal.
  • Payment must be received before the suit is sent over.
  • If you fail to point out a design flaw in the suit that was clearly visible in any of the update photos (of which there will be several), and then request this flaw to be fixed after receiving the suit, you will likely be required to pay an additional fee for the requested alterations.

Custom Commissions

  • At least half of the cost must be paid up front. The other half must be paid upon completion, prior to shipping.
  • You will be the one paying for the fur or fabric that is used. If a set of foot paws are being made, you must pay for and send me appropriately-fitting canvas shoes to use as a base. I will pay for foam, thread, and other miscellaneous supplies.
  • If you request the use of special materials that are not easily purchasable, or that are expensive, I will require you to pay for them.
  • If payment is not provided within two months after completion, and if there is no contact within that two-month period that you didn't warn me about, the suit will be put up for sale as a premade or otherwise used as I see fit. Unexplained loss of contact combined with neglect to provide full payment after the suit's completion will result in you losing the suit.
  • If you cancel your suit's construction, the completed parts of the suit will be put up for sale as premades or otherwise used as I see fit.
  • In the case of cancellations, the refund will depend on how much has already been completed. I may retain a certain amount of the upfront payment based upon the prices of the items that have already been completed.

Communication:

  • An up to date reference sheet of the character you wish me to build must be provided, and must accurately show the character's design. The colors, markings, and shapes must resemble those you want me to incorporate into your suit. Don't send me a reference and then say that something should be different than what is shown on the ref. I will not be responsible for any inaccurate markings/shapes/colors that are not clearly shown on a visual reference.
  • I will not alter the visual design of any fursuit part after it has been completed. Make sure that the reference you provide is what you will want the suit to look like a few months down the road when I complete it.
  • You may contact me using the on-site private messaging system. From there on out, we can keep in touch through Discord or Telegram (the later option would be preferred).
  • I will provide you with regular updates on your suit's progress. This can be done through photos and writing. If you notice something that doesn't match the desired design, you may swiftly notify me and have me change it. This ought to be done as soon as possible, so that the faulty portion can be easily fixed. Any errors that are shown in photos and requested to be edited after initial shipping will require you to pay the return shipping fee, as well an additional fee for the unexpected extra work.
  • Communication will remain professional. Any undesired discussion that is not relevant to the commission and your fursuit will be decidedly ignored, or otherwise avoided.
  • If you are going to be unable to contact me for any long stretch of time (say, a week), please notify me beforehand.

Deadlines

  • If you have a deadline that you would like me to work with, let me know when you first ask to commission me. This way I can tell you whether I'll be able to finish in time, or whether you should look elsewhere for a commission.
  • I will not accept deadlines that are established after I begin work on your fursuit. Bringing up a deadline at any point after materials are purchased, or even after several hours or days of negotiating and figuring things out between each other, is inconsiderate - deadlines create a whole other logistical/stressful factor in the suit-making process, and if I'm going to work with a deadline, I want to know about it before I agree to do the work.
  • Deadlines may increase the price of your commission.

Shipping:

  • Full payment must be provided before shipping.
  • You will pay for the initial shipping of your purchase.
  • You may be allowed to return the suit after the initial shipping (up to 90 days afterwards) in order for technical modifications (damages, incorrect fitting, etc; not visual designs) to be made free of charge. If the suit was damaged due to any fault of my own, you will pay for the shipping to me, I will pay for the shipping back to you. If the suit was damaged due to improper use, storage, or washing, due to it being loaned to a third party, or during attempted alterations by anyone other than me, the repairs will come with a cost. If the suit was damaged or inadequate due to any fault of my own, such as poor sewing, weak connections, improper visual appearance that was pointed out before shipping, etc., the repairs will come free of charge.
  • If your suit is lost during shipping (God forbid), I am not responsible (unless I put the wrong address on it; in that case, I'm very responsible). That would be something to contact the appropriate postal service about.

Resale:

  • Credit must be given to me, the suit's original maker, if you want to sell it or any of its parts away by any means (this includes auctions, raffles, etc.). This is applicable even in the case of reselling the suit or any of its parts after you've made alterations to it/them (credit yourself as well, of course).
  • Unless you or somebody else made modifications to the suit or its parts, do not give credit to yourself or anybody other than me, the suit's creator.
  • Unless you make modifications to the suit, such as altering the fur pattern, adding more parts, or changing it in certain ways such that it becomes noticeably and significantly improved in the sight of a casual viewer, you may not sell it for more than the price you bought it for. Unless you modified the suit, don't sell it for any profit. ('Cause gosh blast it, I worked hard on it and I don't want people to profit from my work without putting any work into the project themselves.) This goes for individual parts as well, applying their respective pricing instead of the price for the whole suit. Special offers and discounts apply.

    This looks pretty good, just a few things to point out. These are all suggestions, not at all saying these have to be there but it would be a good idea to make sure you're covered from as many possible legal issues.

    • A notice that the ToS are subject to change and you can do so with or without notification.
    • If someone cancels a 'suit commission, pointing out that you have the right to modify the design and sell the cancelled 'suit as a pre-made if you want to.
    • I highly recommend your buyers pay initial shipping of the 'suit, and then you can cover shipping if it relates to repairing a defect. Shipping is very expensive. If someone orders say, a fullsuit from you, the shipping cost on that is going to be awful and you're gonna be losing a lot of your profits. You can use USPS's Postage Calculator to see what it would cost.
    • The option of adding insurance to the shipment would be really good, that kind of thing has to go through the post office though. I've never had to do it, so I'll just drop a link to the USPS regarding insured mail. And the pricelist, which includes insurance costs. That's a long page, insurance prices are under Domestic: Extra Services and Fees.
    • A disclaimer stating that you are not responsible if the package is lost or damaged in-transit, and to contact the post office if it got lost/damaged.

    I'm no lawyer, I just advocate covering yourself as much as possible since some people's lawsuit trigger-fingers are just itching for a potential payday.

      So, the desired insurances will be paid for when I drop the suit off at the post office? How exactly does that work?

        I've never had to put insurance on anything, so I have no idea how the process works. I'm trying to read up on it, but I'm struggling to find anything that says how you go about adding it, and what happens if a claim needs to be made on a lost/damaged package. I assume you would be paid the declared value of the shipment, but I'm not entirely sure.

    It looks good! My recommendations:

    Have trackable shipments as a requirement. There are options to ship untracked packages, so having it tracked by default will keep the possibility of losing said package to a minimum.

    If the reference provided is unclear, the commissioner should be responsible for making any alterations or additional drawings before your work starts.

    I would specify just how many changes to a suit you will do .An up-to-date reference should be provided (no major character design changes in the middle of creation).

    This bit: "You will be the one paying for the fur or fabric that is used. If a set of foot paws are being made, you must pay for and send me appropriately-fitting canvas shoes to use as a base. I will pay for foam, thread, and other miscellaneous supplies." This makes me scratch my head. Materials, especially foam, can get really expensive. If you're still comfortable with covering this cost, it's up to you, but I would rephrase this to something like, "Your commission price includes the materials being used for your suit. If a set of foot paws are being made, you must pay for and send me appropriately-fitting canvas shoes with the receipt to use as a base. If you have paid for the suit up front, in full, you will be reimbursed. If you are paying half up front, and the other half upon completion, the cost of the footwear will be deducted at that time."

      Tracking sounds like a good idea, as well as the points relating to the reference.

      Foam isn't all that expensive where I buy it (only about 11$/yard, as I remember), thread is something we have laying around the house, and the only other "miscellaneous supplies" I need is the plastic mesh for the eyes (inexpensive), markers for marking the fabric/foam (inexpensive), and hot glue, which I myself purchase for personal projects as well. And I'm afraid I don't fully understand why it would be better for the buyer to pay for all the supplies except the shoes.

        That's fine; I guess I'm just a grump when it comes to expenses. XD As I said, it's really up to you if you want to cover the less-expensive items, though it can get expensive over time.
