In anticipation of officially opening commissions at the end of the week, I'm taking the opportunity to lay out my official Terms of Service. This is my first time doing such things, so these terms are subject to change as I refine them and figure out what works and doesn't. Thank you for you patience and interest.

General Terms

• I reserve the right to refuse service to anyone for any reason.

• You'll be expected to fully read the Terms of Service. Upon agreeing to a price and commission terms, you are also considered to have accepted these terms.

• What I will and won't create content of is up to my discretion. If you have any questions as to what is or is not accepted, feel free to consult me.

• Accurate references are strongly preferred, and must be provided before work may commence. Any text descriptions should be concise and to the point. Novels are strongly discouraged.

• For 3D commissions, you may request the completed 3D model in the format of your choice (if available) for an additional fee to be determined. This does not grant you permission to modify or use the model in any for profit capacity without the appropriate license.

• During periods of time that I am not accepting commissions, I am still willing to offer rough quotes for future use. Simply follow the instructions under "How to Commission Me" below and I will get back to you with a rough quote. A rough quote is exactly that. Rough. It is subject to change with my pricing. A rough quote is not a guarantee for a commission slot when next I open.

How to Commission Me

1) During an open Commission call, you may note or email me at jadesay[at]hotmail.com with a brief summary of your commission request, any refs or drawings, or any other information you may feel applies.

2) I will respond with a pricing quote based on the information provided, or will request more information until I am able to provide a quote. Once the price is agreed upon by both parties, the commissioner will be entered into the queue. In order to begin work, I require no less than half of the agreed upon payment. Any unpaid amount after starting will be required upon completion of the content. I accept payments through both Paypal and Square invoices. The option is yours. DO NOT SEND PAYMENT VIA GIFT THROUGH PAYPAL. Wait for the invoice and pay through that. Clients may request full refund before initial work has begun. Once work begins, the deposit (half of the agreed upon total) will no longer be refundable. Any amount that has been provided over the base deposit is still refundable. Upon completion of the content, no refunds will be permitted.

3) Upon completion of the commission, the client will be informed via email with watermarked samples. The remaining payment is due at this time. Upon receipt of the outstanding balance, the commissioned content will be provided to the client at that time.

4) Both myself and the client are allowed to post the created content anywhere as long as credit is given. Under no circumstances is the client permitted to post or distribute WIPs or samples. If you have a reason for me to hold off on posting, please let me know ahead of time.

Payment

• I require no less than half payment before starting work on your commission. No exceptions will be made. Unless otherwise stated, I do not offer refunds on that deposit after work has started. I will require the remaining payment upon completion of the commission before I release the end product.

• My listed prices are an estimated range, and may not be indicative of the final price for a commission. Each commission will be individually priced at the time of the original quoting. Both myself and the commissioning party must agree on the final price before any work may begin.

• My prices are subject to change at my own discretion.

• Currently accepted payment methods are via Paypal and Square Invoices. My preferred method is currently via Square Invoices. As such, an additional $3 convenience fee will be added for those wishing to pay via Paypal. Please see the footnote for my reasons regarding this decision***

Completion Time

• Wait times are currently TBD and will be updated.

• My current work queue can be found here.

Changes and corrections

• Major changes may not be possible past the WIP phase. If it was present in the references and I overlooked it, I will remedy that mistake at no charge. If a major change after the WIP phase is needed as a result of a detail not being in the references, an additional fee may be necessary.

• If there's any changes you want made to the created content, the WIP phase is the time to let me know. Extreme changes, or complete redos may or may not be subject to additional fees, depending on the circumstances. Ask.

Content Rights and Reproduction

• When you commission me, the owner of the Character(s) retains the rights to the character(s) I am being commissioned for. However, as the artist, I retain the rights to any content created by me.

• You are allowed to post the created content on your accounts under the condition that you link back to me as the creator. Giving credit is non-negotiable.

• You are NOT permitted to use the created content in any commercial ventures, products, or otherwise for profit. If you do want to be able to use the created content in any form of for profit capacity, you must first discuss the terms with me, and be prepared to pay for the appropriate licensing.

• Edits or modifications to content created by me is not permitted without my permission. If I grant you permission to modify any created content, you MUST state in any post descriptions what you have modified, in addition to linking back to me as the original content creator. Having permission to modify one aspect of the content does not grant you permission to modify any other aspect of the content without further permission.

*** I do not like to use Paypal, but recognize that it is a popular method of payment. As such, I am prepared to offer it as a payment method for my work. However, due to frequent past difficulties I am asking those that choose to pay via Paypal to pay an additional convenience fee.
