So question about customs, I got an idea for one and refs for such does that make it a custom character for that price or would I just pay the 40$ for the full and color?

it makes it a custom character.
Especially if the character does not yet exist.
for a normal commission the character needs a pre-existing reference sheet/pictures of them to work from. Not just ideas and individual pictures of traits.-
