Official Terms of Service by Rotsuoy

--By paying for a commission you state that you have read and agreed to the following Terms of Service. These are subject to change without any notice, but I will do my best to announce any large changes. If you have any questions about the terms, email me before payment is sent.--

~My Process~

1 I receive an EMAIL (rotsuoy_wolfen@hotmail.com) if I am open, and only through this email do I except commission information. If it's not commission related, the email is deleted and possibly flagged and blocked. I hate spam and I hate having commission emails getting lost under spam, so I groom this email account very closely.

I do not work through notes, comments or IM.

This email is either a quote request, or a full description of a commission for the customer. Quote requests are deeply encouraged, and I will give as many with adjustments as necessary. The best part about this is that quotes are not final. If you do not wish to commission me at the time of the quote(s), you don't have to!

I'm an artist that does more with less, meaning that I prefer to have artistic liberties. I love getting references with suggestions that are sweet and simple as well as thoroughly enthusiastic. This gives me the freedom and flexibility to work on something that both you and I can enjoy.

2 I receive payment and all reference images and text before I begin any work.

Payment should be the last step in the initial process, and apon sending payment, I assume that I have all the reference images and text required. Full character sheets as a reference are preferred, but not required. Not everyone has them. Images created by other artists, text descriptions and animal/object/clothing references from Yahoo or Google are also accepted. If images are not given, I'll have to find them myself, but keep in mind that I may not know exactly what you are wanting. If anything is absolutely necessary, please include it in your email. I do occassionally ask for additional references for fine detials such as scars, tattoos, weapons, or just an alternate angle of the character's markings if I feel it would improve the artwork. However, never expect me to ask if you want something included. Be on top of your references!

If no payment is sent after we have discussed the commission, I will reserve your place for 30 days. After which I will remove you from queue and you must re-email me before sending payment. You should never assume I know you are still wanting the commission.

For repeat customers, I will offer a half upfront/half on completion option. The customer must have previously purchased a commission of the same price (or higher) or must be a friend or fellow artist that I can contact and trust.

For complex commissions, I will offer $10 down payment plan that gets you a sketch first, for digital or traditional. After the sketch is made the customer may either cancel the commission or pay the remainder. This option is only available with a $2, non-refundable, convenience fee.

3 I can send off progress images for digital work in the following steps: sketch, preliminary line art, flat colors, and final. Traditional work gets sketch, inks, and final color. PROGRESS IMAGES MUST BE REQUESTED WHEN SENDING DESCRIPTIONS.

I will warn you now, my digital sketches can be very messy. They are there simply to show the composition and skeletal relations of characters to each other. My preliminary line art is better, but can me missing lines from transparent layers or alternate colored layers due to the messiness. The flats show the colors I've picked (I'm very mildly color blind and am prone to mistaking blues for dark greens or purples) and the finished line art. The last stage is after all the shading and dots and tiddles and whatever else I put on have been added. If all of this is to the customers satisfaction, I send a full rez copy, a resized copy suitable for FA and a watermarked copy of the resize. I prefer watermarked images to be posted, but the resized is also acceptable. Please do not redistribute the full resolution copy.

After the customer has approved a stage, there are no changes to it. I will not fix the initial composition once I have sent off the flats, for example.

Any fixes beyond the first 3 are subject to a 5$ charge. I am MUCH more lenient on this when dealing with character sheets as I understand how important they are to the future of the character.

I do not currently have the option to stream the commission to the customer, but should this option arise in the near future this TOS will be updated and word will be sent.

~Usage~

I, as the artist, reserve the right to use any image I create as I see fit.

This includes, but is not limited to, producing and selling prints or portfolios (print or CD), t-shirts, stickers, and/or posting to my online galleries (resized and usually watermarked). I retain full commercial and distribution rights on any image I produce.

The commissioner may use the commission image at any size as they please FOR PERSONAL USE ONLY. That excludes commercial purposes (logos, SecondLife mag use, selling their own prints). No profit is to be made off the image. If posted online, I require being listed as the creator and I would prefer a link back to this gallery. Alterations to the image are NOT ALLOWED without my written consent. I am open to commercial usage rights purchase, but this is on a case by case basis and pricing starts at over $100 USD on top of the normal charges. Please contact me for details.

~"Style" Statement~

I draw in my style. I do not yearn for photo-realism in my work. I will not draw in anyone else's style either. Please familiarize yourself with how I draw, how I color and how I set up my images, for yours will be in the same line. While I am always looking to improve, I do not care for critique of my current style.

~Payment~

I use U.S. Dollars as my currency. I accept PayPal, check, money order and rarely (though never encouraged), well hidden cash.

If you choose to send me a check, money order or cash, make sure you pay for delivery or signature confirmation or something else similar. I am not responsible for the commission if your payment never gets to me. Express or priority mail is always encouraged, but never required. You want the postal service in use to take care of your payment sent, so keep that in mind.

If the commissioner would like to use PayPal for a payment, they are paying me for my TIME not the ART.

It is against Paypal's TOS to use their services for any adult content, and I do my best to stay within their Terms of Service.

If using PayPal, the commissioner will please list their payment for 'services' instead of 'goods' unless the piece is traditional. I get the full name and mailing address of the customer otherwise.

NOTE: I know that marking a payment as a "gift" makes it fee-free, but please don't. Paypal is providing me a service and so I will give them their fee. Also, if the payment is marked as a gift, PayPal will not issue charge-backs, so this rule is for the both of us!

~Refund/Refusal Policy~

I reserve the right to terminate a commission at any time I see fit, or refuse prospective work from any person at any time.

If this happens, I will refund the remaining balance of the commission, subtracting work and materials costs. Depending on the circumstances, the commissioner may or may not receive the completed work and may or may not retain any usage rights whatsoever.

There are NO refunds on completed work. If a traditional piece is damaged in the mail, talk to me about it, but there is usually very little I can do. I offer various forms of shipping if you wish to pay a little extra.

If you desire a refund, please email me at the same email address you initially commissioned me at. Do not hesitate to ask for a refund if the need or desire arises, and do not refuse contact with me because of any feelings you may have about the situation or the commission. IT IS YOUR RESPONSIBILITY TO GET YOUR MONEY BACK.

~Commissions With Several People~

I require written permission from all participants before I begin work.

If the commissioner and the other person are in a relationship (friends or romantic) this is usually not a problem, especially in the case of a gift. If the commissioner does not provide the other person(s) permission, I will ask them myself.

I will draw trademarked characters on a case by case basis. Please read and remember my ["Style" Statement].

It is the responsibility of the main payer, or person who contacted me, to distribute the works in progress to the other participants- not my own.

When requesting progress steps, I suggest that the customer contacts and distributes the work BEFORE responding that everything is correct in the current step. Do not wait until the end and then send me 5-6 things to fix. It is your responsibility as the main payer or primary contact.
