Using Photos as backgrounds for art - Without Permission!? by ArtofZod

Just a view on what others think on this subject, I came across a piece on the Facebook artists group of an artist using a background image taken from a photographer on DA naturally most of this photographer's work has the usual copyright/do not edit/etc however this particular photo he mentions that he wants links to the image on how it is used.

Now how many of your chaps/girls out there would agree to contact the photographer and ask them for permission to use the photo and how many of you would not, if not why? :)

For me, Ive learnt that, creatives do a lot of amazing things for the community, whatever it is, ie photography, painting, clip art etc etc. If there are rights/rules put on an asset or even not always good to check before using any media, plus its nice to just ask the owner if they are ok with you using the media for your own work. Most creators will just say sure and move on, or even ask for a link when it is completed.

Just that form of respect to other fellow creatives that keeps the flow going. I know majority of photos that dont have any set of rules on them and it is automatically public domain but I know images on DA have certain creative common badges on them or a signature under the image mentioning the rights of the image.

    Often, it's actually hard to find the photo's terms of use. I know I've wanted to use one and couldn't find them, so I didn't use it.

      Well if you can not find the link or rights, you can in some cases, link the location of where it was obtained, but thankfully, google now provides image searching tools to look for image likeness. But yea, its always better to just paint it from scratch ;) looks hundred times better than a photo ;)

    In order to be usable in any way a photo has to be “released” by the photographer and subject to the terms of use they dictate, otherwise it is by default not directly usable. Using a photo as a reference or inspiration is a little more of a grey area but in all cases it’s best to credit it as a curtsy if nothing else.

    I always ask permission whenever possible (sometimes it's very hard to track down the original photographer if you found the pic on Google, even using Tineye), and when I couldn't find them, I either wouldn't use it the image, or else would just link back to it, if it is a stock image or something. That's mainly for pose refs though, since I rarely ever do backgrounds, and I also try to change things up as much as I can, so nothing is a direct copy (sometimes I'll use dozens of pose refs for just one image!). :)
