**☞ TERMS OF SERVICE ☜** by Rusco Istar

  1. Any form of payment of a requested quote means that you fully understand and accept to be bound by the following Terms of Service.
  2. I reserve the right to re-phrase, add to, or otherwise modify these Terms of Service to address any unforeseen happening.
  3. Quotes 3.1. I reserve the right to reject a commission. I'm not morally obligated to enter into a commercial-artistic contract with you, specifically if you are asking for a topic I'm not comfortable with or if you have proved to be a troublesome customer. However, once you are in the clear and I accept your proposal I will write to exceed your expectations. 3.2. Contact me for guidance on what might qualify as a mature or an adult commission. Use common sense to rate it. Extra charges aren't that hard to figure out as there is no hidden art to it. Being said that, I have the last word on rating. My veredict won't be unreasonable.
  4. Payment 4.1. I accept payment through Paypal only. Due to ideological reasons payments made with US Dollars won't be accepted until further notice. 4.2. Payment is due upfront, no exceptions, with an optional initial pay of 30% (50% for works with less than 3000 words) to start any writing. 4.3. You have 72 hours from the invoice date to send the payment. If payment is not received in that time, the commission will be canceled and you will need to wait until you get another commission slot with me to have it completed. 4.4. Story/Chapter/Series will be done in proportion to the full payment status.
  5. Cancellation and refunds 5.1. DO THE CANCELLATION AT YOUR OWN RISK! THINK BEFORE YOU PURCHASE A LARGE SCALE COMMISSION!!! 5.2. I reserve the right to cancel and potentially refund your commission for any or no reason at all. 5.3. You might get a full refund if I haven't started anything or if I have only roughly outlined something. 5.4. You may cancel the work only before it goes into proofreading. I'll make a partial refund, that's it, I will take an amount proportional to the work I've already done. 5.5. Once you get the final piece there will be no refunds. 5.6. All refunds are FINAL. They cannot and will not be disputed. 5.7. Upon receiving your refund, your rights to any work completed are revoked. I might reuse the general plot idea for a future work at my sole discretion. Your intellectual property won't be used. 5.8. Refunds cannot be used to “restart” the same commission at a later date. 5.9. I do not provide refunds for personal emergencies that do not apply to the commission. Please find another way to procure the funds you need. 5.10. If I do not have the ability to provide a refund at the time of your request, I will give you a time frame that I am able to do so. Please bear with me.
  6. Privacy and communication 6.1. I avoid using Fur Affinity notes due to cyber-security concerns so all attempts to contact me in that website will fail. 6.2. To keep a proper log of communications, I require all communications be done through e-mail unless otherwise specified. I will give you my business e-mail address once you have contacted me. 6.3. All commission business between us will remain confidential to our e-mail exchange. 6.4. For the use of non-trademark characters that are property of another person you must show me a "proof of permission to use" and give me said person's contact information for verification purposes. If I feel that you are using someone's character without permission, I will contact them about it at my own discretion or respectfully decline your request altogether. If you are gifting some arrangements can be accommodated. 6.5. I will not do business with anybody that speaks on someone else's behalf. I require the interested commissioner communicates with me directly, even if you are not the one paying. 6.6. I use Trello to keep track of commissions. Please check your Trello card before contacting me for information. 6.7. I respect your privacy. For the purposes of Trello tracking you can request me to hide your name. 6.8. I use join.me to stream online. By commissioning me, you allow me to stream your commission publicly at my discretion if I choose to do so.
  7. Deadlines and edits 7.1. I don't accept deadlines under any circumstance. Commissions in the queue will be completed responsibly by following an arbitrary priority that furthers the creativity flow. 7.2. The commissioned story is a piece of art so it might take time to get the right polish. Occasionally I might hit a writer's block or offline activities might take a hold of my time. It is your responsibility to contact me if you have any questions about your commission, I will respond as soon as possible. Please do not commission me if you are not OK with potentially long waits. 7.3. I will deliver many work-in-progress drafts for you to review before it goes into proofreading. The level of completion of these drafts will be proportional to the status of your payment; no final draft will be relayed until the commission has been fully payed. You are responsible for letting me know about any errors in the logic, plot flow, character's portrayal or other features that can be fixed before refinement. If you do not correct issues at this point, I am not responsible for - and will not fix - them later. 7.4. I reserve the right to refuse edits if I find they are not within reason. 7.5. You might be eligible to last minute minor tweaks after proofreading depending on my schedule and if I enjoyed working with you and your piece. However, major changes that might cause me to have to rewrite the plot in whole or in part will come with an extra charge of up to 100% the price of the commission.
  8. Creativity liberties 8.1. The less you give me to work with for a story the more likely it will under-perform against your expectations. If you say "I want so and so happen" then you'll get it but the quality might not be the one you desire. Because I'm not sure what do you exactly want the story may have problems with character development, world building, pacing and/or length, especially if you only give me short sentences to describe what you want. You are giving me the Prima Materia with your communication so don't be afraid to give me a lot of details! 8.2. You can request me to use my own ideas or even give me full freedom with where the story is going. Be careful tho because you are forfeiting your part in the creative process and your right for a rewrite. But fret not much and remember that I'll write the best I can do with the topic you gave me.
  9. Delivery and legal rights 9.1. After your commission has been completed you will receive an .RTF file. I will not provide any extraneous files or notes produced during the creation of the final product after this delivery. 9.2. I reserve the right to not upload or publish your commission. 9.3. This work shall not be used in a writing contest to avoid misrepresentation and/or plagiarism. 9.4. Original works/those which the client holds copyright for the source material include a CC BY-ND Attribution No Derivatives License. You can publish it with no due royalties. 9.5. Works based on third parties copyrighted material include a CC BY-NC-SA Attribution Non-Commercial Share Alike License. The client will hold full liability that the work may cause. A generic trademark warning will be attached at the beginning of the text and you shall not remove it. 9.6. If I find that you have abused these rights or exploited a loophole of any kind, I will revoke your commission privileges permanently and might warn other fellow artists.
