Commission TOS/FAQ (2.1) by PieMan24601

The Commission Process

How do I commission you?

Contact me via notes, or Private Messages, and we will go from there. It's that simple! By sending me a note and starting up this commission process, you are agreeing to my TOS.

What do I say in the note/PM?

First off, please let me know that you are interested in a commission. Then, please include the following:

  • Character references, either typed or visual. Visual is preferred.
  • A very detailed description of exactly what you would like me to draw. If it is a comic or sequence, go step by step and be very descriptive. If there are any discrepancies or if there is any confusion, I will ask you for clarification before moving on.

So I’ve sent the note/PM, what happens now?

After I receive the note, I will begin to plan out how much the commission will cost, how it will look, and I will ask any questions I need to ask in order to get a clearer idea of exactly what it is you would like.

So we figured out exactly what I want, what now?

Once this is done, I will ask for your email that you use with your paypal account. I only accept payments via paypal for online commissions. This email address will then be used to send you an invoice via paypal, to send any WIPS (unless you ask for another method, or are in contact with me via skype or chatting in a stream.) and can be used to send you the final file, (once again, unless you ask for another method) it will not be used for anything else and will remain confidential. Once I get your email address, and everything is worked out, I will send you an invoice for the agreed price.

I’ve gotten the invoice and payed for it, what now?

At this point I will begin to draw a WIP sketch for approval. If this sketch does not meet approval, it can be revised. If you request for me to completely redo the WIP, I will do so, but only once depending on complexity. Demanding constant redraws of the WIP is a direct violation of this TOS, and will result in your commission being canceled with no refund. Once the WIP is approved, I will then move onto the next stage of work. I usually will not move on past a WIP stage with a commission until it is approved by the commissioner. Then once finally done, I’ll send the finished art to you for approval, before posting it to any websites.

Then you will have your art and hopefully be happy with it!

What happens if I win a YCH auction?

If you win the auction, you will be contacted via notes for further information and references. Please reply to this note ASAP, if you do not respond within 24 hours I will have to give the win to the previous bidder before you. If there is no previous bidder, the slot will be filled by characters of my own, or left empty if possible.

COMMISSION TERMS OF SERVICE

I have the right to refuse service to anyone for any reason.

I have the right to cancel a commission for any reason at any time. If I do cancel your commission and you have paid, you will be refunded. If you violate the TOS, you will not be refunded.

Once I begin drawing for you I cannot refund you unless I cancel your commission, so please make sure you can afford my art before you pay.

I do not like to take very long to get artwork done, however situations may arise that delay me or push your work back, keep in mind that your art may take quite a while the more complex it is.

I reserve the right to use the image however I’d like; the only exception is if you requested the image to be private, and it is kept private.

I have the rights to the images I make, so if I see the image used in a way I do not approve of, I will ask to stop and/or remove it.

DO NOT reproduce my work in any shape or form for profits. These are for personal enjoyment and personal use only.
You can repost the work I’ve done for you to your gallery, but you MUST give credit to me or the original image.

I will not draw in someone else’s style; I draw in my own style. I mean, you’re getting my art to get MY art after all, right?

If you wish to color or edit any of my works, you must ask for permission first, and credit me as the original artist. You may pay other artists to color my work. You cannot trace or copy my work. if you do, I will unfortunately have to ban you and blacklist you from commissions as well as take other actions.

If you want me to make a gift for someone, or use someone else’s characters, you must supply proof from the character owner that they give permission for their character to be used. Proof can be supplied by having them contact me via note or PM. If you wanted the art to be some kind of surprise, you will have to show me that they are okay and comfortable with their character being used in the commission, such as showing their gallery or favorites, or showing your connection with them.

I take no responsibility for any deceptive practice on the part of the client; I assume no liability for any proof that has been falsified, or any other shady practice. If I catch a shady practice or false proof, I will do my best to take action and will surely refuse working with the client further.

If you lie to me about gift art permissions or any other permissions and violate this TOS, you will not be refunded, you will be banned/blacklisted, and the art will be removed from any and all galleries.

If there is any breach of TOS or contract I have the right to terminate any business between myself and the client with no refund.

If legal action ever needs to take place, confidential information may be given to a lawyer.
