Terms of Service by Springdragon

Effective as of August 14, 2013, pertaining to all business transactions between Springdragon and Customer, where "Springdragon" refers to myself, Kit Zhu, the business owner and artisan, and "customer" refers to any purchaser or agent of a purchaser of my work, merchandise produced from my work, or who otherwise engages in business with me as pertains to fine and commercial arts.

By engaging in business with me, customer agrees to these terms, unless otherwise negotiated before any work has been completed or payment has been exchanged.

Translation:
The following terms apply between myself and you, the buyer for all future agreements starting as of this post, These terms apply only to art work, and not if you hire me to train your dog or do your taxes.


COMMISSIONS

USAGE
Customer acknowledges that the images and items created are for personal use only, and agree not to use them for any commercial purpose, unless otherwise negotiated for an additional payment. If a change in usage is negotiated after the item or image is created, the customer agrees to pay an additional amount for the right to that use.

Customer will not reproduce1 or redistribute2 the image, or claim ownership of the image in any way, even with modifications, unless otherwise negotiated. Customer may modify the item or image, but may not modify the item or image in a way that removes Springdragon's signature or other identifying marks.
Exception2: Customer may post the image on websites such as Furaffinity, so long as ownership of the image is credited and linked to Springdragon.
Exception1: Customer may print copies of a digital commission in which his or her copyrighted character is featured, for personal use only. Such prints may not be redistributed, including as gifts, unless otherwise negotiated.

Springdragon retains all copyrights to the images and items created. Springdragon retains the right to reproduce and redistribute the items and images for commercial purposes unless otherwise negotiated.

PROCESS
For any transaction of $50 or more, Springdragon will may provide an approval sketch, which is subject to 2 rounds of modifications. The posting of WIP images is considered approval, if no changes are requested by customer at that time. Once the sketch has been approved, large modifications will incur additional payment as compensation for extra work.

PAYMENT
Payment for any transaction must be received in full before any work on the image begins unless otherwise negotiated. If Springdragon is unable to complete commissioned work to reasonable expectations within six months of receiving payment and all information needed to complete the commission, customer will receive a full refund and the commission is cancelled unless an extension is otherwise negotiated. If customer ceases communication about a commission that has already been paid for, after two attempts by Springdragon to contact customer and a hold period of three months from the last correspondence from customer, customer forfeits payment and the commission is cancelled with no further obligation from either party.


PRINTS

All prints will be signed and numbered for identification.

When purchasing a print, customer is entitled to one paper copy of an image and any packaging that is sold with it, for personal use only.
Customer has no rights to the image itself, and agrees not to reproduce the image in any way, including creating digital or non-digital copies, with or without modifications.
Customer agrees not to use the item or the image for any commercial purpose.
Customer agrees not to submit the image or the item to any third party, except as a gift or the resale of the single item.
Ownership of the item continues to carry the above terms.

Translation
When you buy a print, you get a print. You may not make copies, scan it into the computer and post it somewhere, send it to a magazine, use it on the pamphlet for your business, make tshirts out of it, or do anything with it except have it and display it somewhere as a decoration. If you gift or sell the print to any other person, that person is bound by the same rules.


COSTUME ITEMS

SAFETY
Customer assumes all responsibility for safe use of costume items. Springdragon assumes no liability for injuries or other damage sustained while wearing the item, or otherwise caused by the item. By wearing the item, Customer acknowledges that all costume items are sold as novelties intended primarily for display and Springdragon provides no assurance of safe use.

Customer acknowledges that costume heads will impair the wearer's vision and may restrict breathing to some degree, costume hands and feet can impair the wearer's balance and dexterity, and that all costume pieces can cause overheating. Customer will exercise due caution when wearing the items and take necessary health and safety precautions including but not limited to adequate hydration and breaks to cool off.

Customer is advised not to wear costume items in hot weather, during exercise, or for extended periods of time.

REPAIRS AND CONDITION
The item carries no guarantee of condition and Springdragon assumes no responsibility for damage to the item during shipping or use.

Customer acknowledges that costume items should be cleaned and brushed regularly to maintain good condition. Most items can be hand-washed gently with cold water and mild soap, then air dried. Delicate items such as heads can be spritzed with water and wiped down. Please remember to clean inside the heads as well. It is recommended that customer wear sweat absorbing clothing underneath the costume items, to help keep them clean and in good condition.

Please do not attempt to wash any painted items for at least four months after creation, to ensure that the paint has adequate time to completely dry and become not water-soluable.

As a courtesy, items with minor damage associated with normal use will be repaired free of charge, if the customer pays all shipping and handling costs.

Translation:
If you get hurt or break something while wearing a fursuit item that I made, you may not sue me. All uses except display are considered "not intended use".

Please use your common sense about caring for your fursuit. If an eye falls off or a seam rips, send it back to me and I will fix it for free, but I am not legally obligated to do so. If you were doing something stupid, like walking through a campfire or jumping off a bridge, and wrecked your fursuit, I am not going to fix it for you.

You pay both rounds of shipping. for free repairs. You can also find me at some cons, and I can do the repairs there.


ADDENDUMS

Springdragon reserves the right to change the above terms at any time without prior agreement from customer, although a notice may be posted as a courtesy. Customers with past transactions have 14 days to contest or negotiate personal adjustments to any additions to the terms of service, which will also be recorded. It is the sole responsibility of Customer to check for changes to Terms of Service.

Customers have contested commercial use of "Mine Only", within 14 days of agreement. Commercial use rights to "Mine Only" are now null.

Nov 10, 2014 - Idlevalley has purchased the commercial use rights to the paintsketch of Freak. Prints will no longer be available from Springdragon or any distributor other than Idlevalley.

May 21, 2016 - Provision for sketch approval has been removed. There are no customers to which this provision currently applies.
