Terms Of Service (T.O.S.)

Terms of service are subjected to change with notice.

Please note that once a commission has been discussed and payment has been received, the commissioner has agreed to the terms and policies below.

All artworks/commissions completed will be uploaded to the site I have been commissioned from first and linked back to the commissioner. Depending on content is where it will be posted on Tumblr. Clean works will be added to my DeviantArt account.

For examples of my work, please take a look through my galleries to see what I'm familiar with and what I generally draw.

TYPE OF MEDIA

My primary Media type is Digital. I use a mix of different programs when working on a piece. Depending on the piece and commission type, will depend on programs used.

Programs: Paint Tool SAI, Adobe SketchBook, Photoshop, and Krita.

COMMISSION PROCESS

Please be sure to give me your email through notes after you are absolutely sure you want a commission done and payment is final. Emails will be kept between the commissioner and commissioned. It will be needed for Commission Reports and Full Resolution Art Files to be sent to you. You will not be spammed or harassed by me (If you are being spammed by my email, please let me know for I might have been hacked and I am super sorry). This is for keeping record on the service I am providing.

For the time frame of the commission will depend on the amount of commissions I have and the type of commission. It can take anywhere from 3 days to 1-4 weeks and maybe 1-2 months. You will be notified when I have started on your piece by sending you a commission report or I have moved on to finish you commission after those before you.

I will work in order based off of who paid first and/or what type of commission it is. Simple pieces will be knocked out first and more complex will be saved for last or will be worked on a bit in between during the sketching process.

You must be 18 years or older to order mature content from me. If you give me a false age and you end up being younger then 18 years of age, I will not be held accountable for any trouble you come across from family or otherwise. Payment(s) will not be refunded after ark work is completed. So please be honest with me since this IS the Internet.

As part of my service, I do Commission Reports of my stages of completion. Through email, I will send small samples of where I am at in the commission and will ask for some last minute forgotten details I might have missed from a reference provided or linked to me.

There are no previews for sketch commissions.

--For Full Body/Bust Colored/Full and Simple Shading commissions (Includes Chibis)--

Commission Report #1-1.5: In this stage you will receive a few thumbnails to select from or combine that will have a few different poses if you are unsure and give me creative freedom. Great time for any last minute additions of missed/overlooked details when I reach a cleaner sketch. Rough color might be added. After this Report, no extra details can be added or changed with out extra charge. The amount charged will depends on the extra detail that needs to be added.

Commission Report #2: Simple Base color of character (and background if one is part of commission). Simple color changes can be made during this report and resubmitted for final stages of the commission. If last minute additions are complex and will cause too many changes, it will be announced to commissioner and not added. If it’s imperative that this changes need to be done a large charge will be placed on the tab. So please make sure during the first report and a half that you give me everything I need.

Final Repot: I will note you on the completion of the piece and post the proper sight sizes for the image. I will send you the full resolution pieces threw email via Drop Box. If you have a half/half payment deal with me, you will need to pay the rest first before receive the final.

---For Full Body/Bust Simple Base colored art (Inludes Chibis)---

Commission Report #1-1.5: In this stage you will still receive a few thumbnails if you are unsure of a pose for your character. After you have chosen the image will become a clean sketch. Great time for any last minute additions of missed/overlooked details. Rough color will be added. After this report there will be no last minute additions.

Final Report: I will note you on the completion of the piece and post the proper sight sizes for the image. I will send you the full resolution pieces threw email via Drop Box. It will be a direct link the your piece. If you have a half/half payment deal with me, you will need to pay the rest before receive the final.

---For Full Body Painting Commissions (Includes Chibis)---

Be absolutely sure you like what you see before giving me an approval to continue, for it will be difficult to add anything after simple changed sketches once I get to the base stage.

If you provided me with only a description and no visual reference, I will try my very best to get your ideas down and help you through the process. However I am not responsible for inaccuracies.

If you ask me to add or change something that was not discussed or presented before I begin the commission, there will be an additional charge for every new change.

Commissioners are more than welcome to check in for updates or reminders. I will post updates on my page next to commissioners name on where I am as along with the email reports.

Once I finish your commission, there will be no edits or refunds.

PAYMENT METHOD

I accept PayPal only with cash related commissions. I require commissioner's PayPal info so that I may send out an invoice.

I must receive half or full payment before I start. The last half of the payment must be sent before you receive your image. After the payment is received the post will be made and the original resolution file link emailed to you. If the file is small enough to send through email, then that is what will happen. If the image is too large, it will be uploaded to my Drop Box and the link to your image will be sent. You MUST send me confirmation that you have received the image for record proposes. Full resolution file might take time to reach you depending on home Internet condition for the initial upload. If the link isn’t sent the same day the image is finished, an attempt for that night will be made. If all else fails the next day is a guarantee. You will be notified about any delay.

TURNAROUND TIME

Assuming the commission has been paid, the time it will take to complete it depends on the complexity of the piece and how many are in line.

I am currently not a student or have a part time job but am working towards joining the military. So for the time being am free to work on commissions till that time. I do plan to continue commission after boot camp when I am situated in my branch.

Commissions will be worked on in between my workouts and at night.

I will not accept deadlines. If the commission is a gift for someone’s birthday, please give me at least a 2-3week, or depending on the complexity of the piece it might take a month or two, notice before commissioning me. I will not be held responsible for not completing the work in time for the birthday commission. But I will try my best to get it completed before that time in respect to the birthday star.

COPYRIGHTS AND USAGE

Reposting is only allowed by the commissioner and other parties included.

You (the commissioner) have the right to do as you please with your commission as long as credit is linked back to me (the artist). Please do not claim artwork as your own.

I (the artist) refrain anyone from removing my signature from any of my works.

You (the commissioner) may not use your commission for profit gaining.

I (the artist) have the right to turn down any commissions without reason.

I (the artist) have the right to include commissions in any future advertisements and/or portfolios when necessary.

I (the artist), out of respect for the commissioner, will not use his/her commission as merchandise, like prints, without permission.

CANCELLATIONS/ REFUNDS

You are paying for my time and service.

If you cancel before I start on your commission, I will refund your payment in full. But please let me know. I cannot read minds. You do not need to explain to me the reason if it is too personal. I will understand. I will keep hold any reference images you sent me or linked me to in you own personal file in my commissions folder for any future commissions you ask of me. These will not be used for anything other then a reference to your commission requests.

If you ordered a colored picture and I finished the Sketch/Base portion, you will receive back only the amount I haven't finished; with the option of receiving the artwork as it is.

There are no refunds for sketch commissions.

Any canceled works in progress (WIP) and unclaimed commissions will be changed and used as something I see fit. They will not be used for resale or any profit, but rather for advertisement of my skill, portfolios and examples for future commission price sheets.

HARASSMENT/ PROBLEMATIC SITUATIONS

I will let you know right now. I will not accept ANY harassment of any kind. Be patient with your commission. I am only human. I can be a really nice and an understanding person.

Harassment will not be tolerable of any kind and will result in you being blocked; repeating offenders will be black listed. I know this seems harsh but you need to treat others how you want to be treated.

If a problem arises during the commission process and I am not able to work out the problem with you, I will cancel your commission, refund you the amount that was not completed and block/black list you. This applies to people who are rude to me during my commission reports. If something is wrong with the image, please act like an adult and calmly tell me without foul and unnecessary language. If you have a problem trying to convey your needs and/or wants, you can add me on Skype and we can discuss the issue on call and work out your requested commission.

Any refusal of refunds, if and when I present them, will count as a donation to my cause or goal. Treat me like a human being, with respect and professionalism, and I will do my upmost to give you the best service I can. Refusals will depend on your behavior towards me.

If you file a dispute against me to paypal in attempts to scam them and myself in trying to claim the payment for the service back. Not only will I fight back, but will openly announce the dispute to inform and warn others to avoid and be cautious when commissioning and to backlist and block the scammer.
